Amanda Bynes' parents 'headed to court to request temporary conservatorship of their daughter'

Amanda Bynes' parents, Rick and Lynn, are said to be headed to court on Friday in Ventura County, California to request temporary conservatorship of their daughter.

As the actress' erratic behavior worsens, her parents believe she is unable to look after herself both personally and financially, RadarOnline.com is reporting.

'Rick and Lynn will appear before the judge on Friday to ask for a temporary conservatorship of their daughter, Amanda,' a source told the news site.

'Her parents will both be petitioning to be the temporary proposed conservators, and want control of her personal and financial affairs.'

In California, 'the proposed conservator must show that the conservatee is unable to care for themselves, and is a danger to others,' the source added.

Amanda's parents 'are hopeful that the judge will take into consideration that she tried to start a fire in a stranger’s driveway, and burned her pants in the process.

'Her behavior is completely unpredictable, and she needs long term mental health help,' the source said.

Although Amanda's in for a difficult time ahead, she's not going to be charged with another crime, TMZ is reporting.

According to TMZ, prosecutors will not charge Amanda with trespass, arson or any other criminal offense in connection with Monday's firestarting incident because police and prosecutors view her behavior as that of a mentally ill person.

Her uncle Ronald has also spoken out about the situation and told Celebuzz: 'I know she’s on a 72-hour hold and there was a recap of the fire on TV. It’s terrible.'

He added: 'I really don’t know [what’s wrong]. This happens to a lot of stars, you start out young then something happens.'

Ronald revealed he hasn't seen his niece in years, and while he talks to his brother Rick Bynes regularly, they don't speak about Amanda's troubles.

'It’s such a touchy situation,' he said. 'I don’t like calling them about this. I’m trying to stay out of it for now because I don’t know what to do.'

On Monday, Amanda caused waves of alarm after rushing to a liquor store in a panicked effort to 'wash her pet dog after accidentally drenching it in gasoline'.

New surveillance video from inside the store posted on TMZ shows the star entering the shop holding the Pomeranian and walking through to a back area in an alleged attempt to remove the fuel from its fur.

The incident happened minutes after Amanda allegedly used a canister of gasoline to fuel a fire outside a random elderly woman's home in Thousand Oaks, California on Monday night.

The video shows the actress wearing a blonde wig, white top and trousers wondering around the store before walking into an 'employees only' restricted area, according to the website.

Alarmed, the cashier followed Amanda to confront her and she apparently 'freaked out' and left.

The owner of the store told TMZ that the cashier detected a 'strong odour' of gasoline and 'observed Bynes attempting to rinse off the dog in a sink in the back area.'

The whereabouts of the Pomeranian are currently unknown.

Amanda is currently being held under a 5150 hold for mental health evaluation, with TMZ reporting she is exhibiting signs of schizophrenia.

The website reports medical professionals will seek a two week extension to her 5150 psychiatric hold in order for 'doctors to properly diagnose her.'

People close to Amanda are said to be 'convinced' she is suffering from mental illness and her friend and ex-publicist Jonathan Jaxson confirmed to Entertainment Tonight on Wednesday that the actress will be staying in a psychiatric ward for an additional fortnight.

According to Jaxson, Amanda's parents Lynn and Rick are meeting with lawyers to discuss taking control over their 27-year-old daughter's finances and well being after being called in by her doctor.

The actress was found by sheriff's deputies about 9pm standing near the fire burning at the house in Thousand Oaks, according to Captain Don Aguilar of the Ventura County Sheriff's Department.

Amanda allegedly started the fire in an elderly woman's driveway, screaming her dog had been burned and igniting her trousers.

Both the sheriff and fire departments responded to an emergency 911 call regarding a gasoline tank fire in a driveway, Aguilar said on Tuesday.

Homeowner Bonnie Braaten said police deputies later identified the woman as Amanda and said she had burned a part of her own clothing. 'It sounded like her clothing had been sort of singed,' she told TMZ.

'I have no idea what she was doing,' Ms Braaten added to Us Weekly. 'I don't even think she has an idea what she was doing.'

Ms Braaten's neighbour Bruno Corsi, is reported to have extinguished the fire.

After emerging from his garage, he told Us Weekly he saw 'a bunch of teenage kids who were trying to stop the fire and one lady with long blonde hair sitting on the sidewalk'.

'There was a gas can, a two or three-gallon container,' he added. 'It was melting. If it were metal, it would have exploded, but it was plastic. [There were] four- or five-feet flames.'

Ms Braaten was at the back of her house watching television, and did not learn about the blaze until the sheriff rang her doorbell.

'The sheriff told me that Amanda was incapable of giving good answers,' she told Us. 'I never saw her. She was already in custody or wherever she was taken.'

Passerby Andrew Liverpool said he was driving along when he saw a woman with her 'left pant leg on fire. After pulling over, he saw the woman grab her dog.

Amanda tried to leave in a taxi, but Liverpool said he stopped the cab from leaving.

'She was really frantic and she was like "my dog has been burned,"' Liverpool said.

A male caller to 911 reported a piece of cloth burning on a gasoline tank on a driveway and a second female caller confirmed a gasoline tank and fire, according to TMZ.

Amanda was questioned by Ventura County Sheriff's Department deputies who determined she met the criteria for a psychiatric hold and she was detained, Aguilar said.

The 5150 hold is named after the California state code that allows for involuntary hospitalisation for a mental health evaluation.

A person can be held against their will for up to 72 hours under such a hold.

If Amanda's parents, Rick and Lynn, are going to a judge to seek conservatorship of Amanda, they must act to take legal control quickly before she is released from her psychiatric hold, a source told RadarOnline.

And according to TMZ, they are refusing to pay for the fire damage their daughter allegedly caused, saying: 'Amanda needs to pay for it.'

However, according to Captain Aguilar, Amanda will not face any criminal charges related to the driveway fire that prompted her involuntary confinement.

Emergency medical responders were at the scene, but there were no injuries and no medical aide was rendered, he added.

Amanda's listed attorneys in an industry database, Richard Hutton and David Feldman, declined to comment on Tuesday.

Hours before the fire, Amanda was pictured in a dishevelled state, shopping in Bloomingdales in Santa Monica in a matted blonde wig,  long T-shirt and flip-flops.

Amanda was born and raised in affluent Thousand Oaks, which is about 35 miles northwest of downtown Los Angeles and had been living in New York City since last autumn.

She was forced to return home to Southern California after she went broke and 'ran out of money she had access to' a source told Radar, adding the star could not find an apartment in New York.

'Amanda was unable to find any place to live in New York City because of her bizarre behaviour,' the insider said. 'No one would rent an apartment to her. She does own a house in Calabasas (California). It’s unclear how she got to California from New York.'

The source also said she does not carry a valid drivers license in either state.

Amanda underwent a psychiatric evaluation in May after being arrested in New York City for investigation of drug possession and alleged evidence tampering for throwing a bong out of her high-rise window.

Pop singer Britney Spears was infamously placed on a 5150 hold in 2008 after a public mental breakdown.

Amanda has her own lengthy list of odd behaviour.

She was recently evicted from her suite at a Ritz-Carlton hotel in New York City after allegedly smoking marijuana in her room and racking up a $2,000 room service bill.

The former All That star also has frequently lashed out at a wide variety of celebrities on Twitter, ranging from Lance Bass to Jason Biggs.

Her eccentric behaviour appeared to begin with her retirement from acting and move to New York.

She shaved her head because of 'hair damage,' has been photographed in New York smoking suspicious looking cigarettes and was allegedly booted from her gym for 'smoking marijuana.'

The Easy A star also has had several run-ins with the law in California.

The Hairspray star resolved a hit-and-run case back in December after entering into a civil settlement with the other drivers.

Prosecutors had  charged her with driving on a suspended license after it was temporarily taken away from her following two hit-and-run cases where she was accused of leaving the scene without providing proper information.

She has also pleaded not guilty to drink driving in a separate case.

Amanda was once one of the biggest actors on children's television in the U.S.

She won four straight Kids Choice Awards for best television actress for her roles in the ensemble variety show All That and for her own vehicle The Amanda Show in the early 2000s.

The also received Kids Choice Awards for best movie actress for her roles in Big Fat Liar and What A Girl Wants.
